Facts

Respondents sued appellant for a declaration of title to a parcel of land, damages for trespass and an injunction.

Appellant raised the equit¬able doctrine of acquiescence, laches and standing by on the ground that the re¬spondent remained in Lagos while the alleged wrongs took place.

Respondents countered by showing evidence that they had protested against the presence of the appellant on the said land.

The Court gave judgement to the respondents and the High court also confirmed that judgement.

The appellants further appealed to the Appeal and Supreme Court.
